Description:

Prohibited action complaints under the Workers Compensation Act can have significant implications for employers. Yet, many still find themselves ill-equipped to address these complaints when WorkSafeBC invites a response. With a reverse onus putting the burden on the employer to rebut the presumption that it retaliated against the worker for raising a health and safety concern or exercising a protected right or duty, even the most well-intentioned employers may be faced with a finding that they have committed a prohibited action. This session will provide tips and strategies for employers to effectively respond to prohibited action complaints in their workplaces.

It will also provide insight on impending B.C. legislation focused on promoting equality, diversity, and inclusion. Of note, the anticipated anti-racism data legislation and potential pay transparency legislation will be discussed.

Keynote Speaker Highlights

Carman Overholt, QC

Carman is a senior litigation lawyer with extensive experience in all aspects of employment law, labour relations and commercial litigation. He works closely with senior management and human resources professionals to help employers stay in compliance with the legislation that governs the workplace. Carman provides clients with advice, strategies and policies that reduce the risk of employment disputes and claims. Given his extensive experience, Carman is able to efficiently advise employees on contractual matters including severance and continuing post-employment obligations. His practice includes drafting and negotiating terms of employment and independent contracts for services. Carman is a frequent lecturer and routinely presents on the most recent developments in the law including the duty to accommodate, social media issues, privacy obligations and the protection of an employer’s business interests. He is a Co-Author of the Employment Litigation Manual published by Butterworths/LexisNexis since 2007. His lecturing includes annual courses for the Sauder School of Business and the Queen's University Industrial Relations Centre. His leadership, legal work and community service were recognized by his appointment as Queen’s Counsel in 2002. Carman is the recipient of he Harry Rankin, QC Pro-Bono Award and the Queen’s University Kathleen Beaumont-Hill Award for outstanding service to the community.

Lana Tsang & Amanda Alberti

Lana Tsang - Lana practices in the area of corporate and commercial litigation, administrative and employment law. She advises her clients on a broad range of issues involving complex contractual disputes, tort claims, construction, builders’ liens, collection and enforcement of debts, workplace law including wrongful dismissals, human rights complaints, and prohibited action complaints under the Workers Compensation Act. Lana is a steadfast advocate and has appeared before all levels of court in British Columbia and assisted on matters before the Supreme Court of Canada. She has also attended and appeared on matters before various administrative tribunals in British Columbia.

Amanda Alberti - Amanda represents both public and private sector employers in workplace law matters. She takes a thoughtful, detail-oriented approach to finding effective solutions for her clients. Amanda has assisted clients in a variety of civil litigation proceedings at levels of court in British Columbia, as well as in workers’ compensation and occupational health and safety matters before the WorkSafeBC Review Division and Workers’ Compensation Appeal Tribunal.

Bobby Sangha

Bobby Sangha is an associate of Roper Greyell LLP, where he practises in all areas of labour, employment, and human rights law. He advises and assists employers operating in union and non-union environments, including public sector organizations and societies. As an advisor, he endeavours to understand the fundamentals of a client’s operation in order to provide meaningful assistance. As an advocate, he tailors his recommendations and approach to the distinct circumstances. Bobby is further an executive member of the CBABC Labour Law Section, a coach of the UBC Law Team for the National Labour Arbitration Competition, and a craft beer enthusiast.
