The law of wrongful dismissal continues to evolve reflecting the changes in our society and economy. The security of a well written employment agreement is not necessarily sufficient to avoid the risk of significant claims arising upon the termination of the employment relationship. Human Resources professionals and senior executive management many encounter claims that are not easily managed or settled. This session will identify the nature of potential claims that arise which will involve significant time and resources to manage.

"Prohibited Action Complaints under the Workers Compensation Act: Tips and Strategies for an Effective Employer Response"

Description:
Prohibited action complaints under the Workers Compensation Act can have significant implications for employers. Yet, many still find themselves ill-equipped to address these complaints when WorkSafeBC invites a response. With a reverse onus putting the burden on the employer to rebut the presumption that it retaliated against the worker for raising a health and safety concern or exercising a protected right or duty, even the most well-intentioned employers may be faced with a finding that they have committed a prohibited action. This session will provide tips and strategies for employers to effectively respond to prohibited action complaints in their workplaces.

Description:
This session will explore the impact of global trends for employers operating in union and non-union environments. In particular, it will provide an overview of legal issues and related best practices in implementing a remote work program and a four-day workweek. It will also provide insight on impending B.C. legislation focused on promoting equality, diversity, and inclusion. Of note, the anticipated anti-racism data legislation and potential pay transparency legislation will be discussed.

Course Survey
Lana Tsang - Lana practices in the area of corporate and commercial litigation, administrative and employment law. She advises her clients on a broad range of issues involving complex contractual disputes, tort claims, construction, builders’ liens, collection and enforcement of debts, workplace law including wrongful dismissals, human rights complaints, and prohibited action complaints under the Workers Compensation Act. Lana is a steadfast advocate and has appeared before all levels of court in British Columbia and assisted on matters before the Supreme Court of Canada. She has also attended and appeared on matters before various administrative tribunals in British Columbia.
Amanda Alberti - Amanda represents both public and private sector employers in workplace law matters. She takes a thoughtful, detail-oriented approach to finding effective solutions for her clients. Amanda has assisted clients in a variety of civil litigation proceedings at levels of court in British Columbia, as well as in workers’ compensation and occupational health and safety matters before the WorkSafeBC Review Division and Workers’ Compensation Appeal Tribunal.
